Private international law

SLP advises Italian clients and foreign nationals in the field of private international law, otherwise known as conflict of laws. This field is made up of international conventions and treaties, European Community Regulations and Directives, and other laws and instruments that regulate private relationships across national borders. For example, a legal query involving divorce law or the law of wills and successions becomes more complex where the parties are of different nationalities or where assets are based in more than one country, and may involve the consideration of international law together with the domestic law of each state involved. The rules of private international law will determine matters such as which country’s court has jurisdiction to hear a case, or how a person should be served with notice of legal proceedings.

New laws are currently being drafted, particularly within the European Union where fast-growing numbers of people are moving from country to country for marriage, business or to purchase property, and by the treaty organisation “Hague Conference on Private International Law”, to harmonise conflicting laws between member states and provide some a uniform system in cross- border disputes.
